*Ed. Note: ’’All regular lot requirements” means that <br />1. Property must have double the dry buildable acreage required <br />for a principle structure; and <br />2. Guest house must be located so that it could be subdivided off <br />from main house and both main house and guest house would <br />have conforming setbacks from lot lines, etc. <br />3. Accessory Building with Plumbing are those accessory structures which are neither intended nor <br />used for overnight occupancy. Overnight use would presumably make them dwelling units, which triggers <br />the Guest House status and need for a CUP. <br />Accessory Buildings with Plumbing are divided into two categories: <br />a)Those that do not contain any of these fixtures: bathtub, toilet, or shower. These are subject <br />to an administrative permit and covenant filing: and <br />Those that ds contain one or more of any of these fixtures: bathtub, a toilet, or a shower (or <br />a combination of these fixtures). These require a Plumbing in Accessory Building CUP. <br />Accessory Buildings with Plumbing are governed by Section 10.03, Subd. 9(F): <br />10.03, Subd. 9. Accessory Buildings. <br />F. Plumbing. Because the provision of plumbing fixtures and wastewater <br />plumbing in accessory buildings has the potential to allow such buildings to <br />be used as dwelling units, and because it is the policy of the City to limit <br />residential development density to the allowed densities within the respective <br />zoning districts, plumbing in accessory buildings shall be regulated as follows: <br />1.The provision of outside sillcocks and indoor water supply shall be <br />allowed in any accessory building that is conforming in location, size <br />and height. <br />2. Installation of any combination of fixtures requiring wastewater <br />plumbing that does ivqI include a toilet, shower or bathtub shall be <br />allowed in any accessory building that is conforming in location, size <br />and height, subject to provision of municipal sanitary sewer or <br />a conforming sewage treatment system designed to handle the <br />anticipated flows from such fixtures, and subject to the property <br />owner executing a covenant providing that: <br />a. <br />b. <br />c. <br />Accessory building will not be used for a home occupation <br />unless specifically approved by City or if allowed by City code. <br />Accessory building will not be used as a dwelling unless a <br />guest house CUP is obtained. <br />Accessory building will not be rented, leased or otherwise <br />provided for use as a dwelling under any circumstances.
