City Code S8>l(a) Maintenance of Private Property <br />Background <br />In October and November 2003 Stevan Wagner presented information to the Planning <br />Commission regarding a commercial site plan review for a building expansion on his <br />commercial property at 3607 & 3609 Shoreline Drive, within the B-1 Zoning District. <br />The application was tabled at the October 9* Planning Commission meeting and was <br />brought to the November 5*** Planning Commission work session for further discussion. <br />During the November work session Planning Commission asked the applicant to provide <br />more detailed information and receive approval from other jurisdictional permitting <br />authorities such as the Hennepin County Environmental Services, Minnesota Pollution <br />Control Agency (MPCA) and Minnehaha Creek Watershed District (MCWD). <br />To date the applicant has complied with Hennepin County Environmental Services <br />hazardous waste generator requirements, applied for a MPCA Industrial Waste Water <br />Permit and received a permit (for Rule B: Erosion Control and Rule N: Stormwater <br />Management) from the MCWD. The Rule B permit states that erosion control consisting <br />of a silt fence and a gravel construction entrance have been approved, and the Rule N <br />permit states that the applicant ’s project requires Best Management Practices (BMP) and <br />rate control in order the fulfill the stormwater management practices of Rule N. The <br />MCWD has determined that stormwater runoff rates will not increase as a result of the <br />proposed project. The applicant has proposed to the MCWD that he will convert a 3’ <br />wide area along the west property bound^ fix>m gravel to Minnesota wild grasses and <br />will install a rock drain with a skimming structure (PIG) for the proposed equipment <br />wash site as BMPs. <br />The following definition was taken from Minnesota Statute §103F.711, Minnesota Clean <br />Water Partnership Act: Best Management Practices (BMP) are practices, techniques, and <br />measures that prevent or reduce water pollution from nonpoint souices by using the most <br />effective and practicable means of achieving water quality goals. Best management <br />practices include, but are not limited to, official controls, structural and nonstructural <br />controls, and operation and maintenance procedures.
