Currently, there is a <br />total of 2,608 s.f. of hardcover in this zone where none is allowed. This hardcover <br />consists of a home, deck, patio and retaining walls. There is currently 21.61% hardcover <br />in the 0-75’ setback zone, and a total of 25% or 7,530 s.f. for the combined areas of 0-75’ <br />and 75 ’- 250’ setback zones. The applicant is proposing to reduce this level by 52 s.f.. <br />The existing grade level deck is located entirely within the lake setback. Any proposed <br />change in the hardcover within the 0-75’ setback zone requires a variance as the <br />hardcover level in the area is non-conforming at 21.61%. The applicant is proposing to <br />reduce the hardcover level by 52 s.f. with the removal of the existing deck and adding a <br />smaller stone patio to achieve a level within the 0-75’ zone of 21.18%. <br />Hardship Statement <br />The applicant has completed the Hardship Documentation Form, attached as Exhibit B, <br />and should be asked for additional testimony regarding the application. <br />Hardship Analysis <br />In considering applications for variance, the Planning Commission shall consider the effect of the <br />proposed variance upon the hetdth, safety and welfare of the community, existing and anticipated traffic <br />coiuUtions, light and air, danger of fire, risk to the public safety, and the effect on values of property in <br />the surrouttding area. The Planning Commission shall consider recommeruting approval for variatues <br />from the literal provisions of the Zoning Code in instances where their strict enforcement would cattse <br />undue hardship because of circumstances unique to the individual property tutder consideration, and <br />shall recommend approvrd only when it is demonstrated that such actions will be in keeping with the <br />spirit and intent of Orono Zoning Code. <br />The applicant wishes to remove a total of 52 s.f. of hardcover from the 0-75’ zoi.e. The <br />deck will be removed; therefore a variance is required to put nonconforming hardcover <br />back in the form of a non-structural patio. <br />7 <br />i i <br />• r <br />1 r- <br />> ^
