MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, January 20, 2004 <br />6:00 o’clock p.m. <br />Acting Chair Mabusth moved, Fritzler seconded, to table Application #04-2974, StoneBay <br />Marketpiace, NW Quadrant Hwy 12/Wiliow Drive, a Proposed Commercial PUD <br />Development, in addition, when the final Comprehensive Plan Amendment, PUD Rezoning, <br />Commercial Site Plan Review, and Preliminary Subdivision is presented, that they be <br />accompanied by a progress report of where the original StoneBay development project is at <br />currently. VOTE: Ayes 5, Nays 0. <br />(#15) #04-2976 JAMES AND JUDITH PIERPONT, 1801 WEST FARM ROAD, <br />CONDITIONAL USE PERMIT (10:20-10:53 P.M.) <br />James Picipont, the Applicant, was present. <br />Gaffron explained that the property at 1801 West Farm Road contains a principal residence and a <br />guest house originally approved via CUP Resolution No.2854 in 1990. During the recent lot line <br />rearrangement review, it was confirmed that the legal combination condition of Resolution No. <br />2854 had never been fulfilled. It was also confirmed that the applicants at this time do not want to <br />combine the properties (1801-1849) and the Planning Commission and Council confirmed that the <br />3 ac. diy/1 ac. wetland area of 1801 West Farm was not sufficient to meet the intent of the Guest <br />House ordinance regarding lot area. <br />Based on the recommendations of the Planning Commission, Council conditioned lot line <br />rearrangement approval on successfully obtaining a CUP for Plumbing in an Accessory Building, <br />with the understanding that the kitchen in the guest house would have to be removed. Because the <br />City will not accept continuation of the Guest House use without 4.0 acres of dry builJablc land, <br />applicant has chosen to pursue a Plumbing in Accessory Building CUP. Discussions at the Council <br />level cstoblished that removal of the kitchen facilities from the existing guest house structure would <br />be required, but the plumbing would be allowed to remain subject to applicant successfully <br />obtainmg a CUP. The lot line rearrangement approval does not take effect until the Plumbing in <br />Accessory Building CUP is obtained. <br />Gaffron pointed out that 1801 West Farm Road has been confirmed to have a site for construction <br />PAGE 44 of 64 <br />I
