Staff Recommendation: Planning Department Staff recommends approval of the variance and conditional use permit as requested with the following provisions: 1. Density of the vegetation on the lot is to be kept such that the visual impact from Wear Circle is minimized. 2. No access to Wear Circle for proposed bam. Hardship: Staff finds a hardship exists in that the situation which destroyed the barn was a situation not created by the applicant.___________________________________ Pertinent Zoning Ordinance Sections Sec. 78-1431. Conditional use permit required. All accessory buildings on through lots located in R districts shall require a conditional use permit. Sec. 78-1434. Area restrictions. In all R districts, no accessory building shall exceed 1,000 square feet of footprint area; except that accessory structures in excess of 1,000 square feet will be allowed under the following conditions: (1) Not more than one oversized accessory structure (OAS) shall be permitted on any property. &V 'i It j
