A RESOLUTION DENYING <br />VARIANCES PER MUNICIPAL ZONING CODE <br />SECTIONS 78-350 (B), 78-1403, <br />78-282, AND 78-1288 <br />FILE 803-2962 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City <br />Council of the City of Orono has adopted zoning regulation for the protection of the <br />public health, safety and genera! welfare; and <br />WHEREAS, Thomas b Swanson and Marilyn Swanson, husband and wife and <br />the owners of the property located at 1740 Shady wood Road, with Robert Switz and <br />Joanne Switz, husband and wife, having interest in the property (hereinafter “the <br />applicants ”) within the City of Orono (hereinafter “the City ”) and legally described as <br />follows: <br />Lots 14 & 15, Shad>Avood, Hennepin County, Minnesota <br />(hereinafter “the property ”); and <br />WHEREAS, the applicants have applied to the City of Orono for variances to <br />permit a construction of a new residence requesting the following approvals: <br />I.Section 78-350: To allow a rebuild of a lot where the area is 0.47 acres <br />when 0.50 acres is normallv allowed. <br />Section 78-1403: To allow structural coverage to increase from <br />approximately 3,094 s.f. (15%) to 3,895 s.f. (19%). <br />3.Section 78-282 and Section 78-1288: To allow hardcover in the 75-250 ’ <br />zone to increase from 4.428 s.f. (39%) to 5.027 s.f. (44%). <br />WHEREAS, the City Council has reviewed the application; the recommendation <br />of the City staff and Planning Commission; and the comments and ^^Titten statements <br />submitted by the applicants. <br />Page 1 of 3 <br />I <br />I
