Tha pond could be claaalfiad as a <br />decorative pond with a secondary purpoaa of providing drainage of <br />jBolsture content of aolls surrounding tha pond araa. Mr. Harris <br />pj^oposes putting a fanca around the pond to pravant his horsaa <br />from Interfering with tha function of the pond. He intends to <br />inaediately seed the banks. The pond will not change the <br />existing drainage, but rather will provide greater retention. <br />Chairman Kelley inquired as to where tha spoils would be <br />placed? Mabuath was not certain* but the applicant indicated <br />that he Intended to keep thaa on his property. <br />Chairman Kelley asked if It would *oe necessary for the City <br />to take a drainage and flowage easement for the pond? Mabusth <br />stated that the pond was such a local retention area that such an <br />easement may not be necessary. Kelley said that should tha <br />property over be subdivided, the City may wish to have the <br />uasesient. Be also suggested that the City be consistent with its <br />easement policy. Planning Commissioner Johnson questioned the <br />City's possible Bialntenance liability that may result from taking <br />a drainage easement:. <br />Mr. Robert Taylor informed the Planning Commission that in <br />the beat of his knowledge, there was an underlying draintlla in <br />tr.o area of Mr. Harris' proposed pond.
