Zoning File #1779 <br />November 6, 1992 <br />Page 2 <br />Lakeshore Strip <br />This property is the remnants of the underlying "Government <br />Lot 3" and contains a 0.24 acre, 33' wide strip of land leading <br />to Browns Bay, and is separated from the main parcel by County <br />Road 15 and the Dakota Rail right-of-way. Staff recommends that <br />this strip be platted as an outlot, and be designated for <br />ownership with Lot 1 or Lot 2. Alternatively, it could be <br />designated for sale to an adjacent property only. In either <br />case, the City will request additional right-of-way for a <br />triangular portion of Orono Lane. <br />Septic System Requirements <br />Septic system testing has been provided to indicate that, <br />absent any additional road dedications, primary and alternate <br />drainfields can be developed under City and State codes to serve <br />a 5 bedroom house on the 2 acre, unsewered parcel. However, if <br />additional right-of-way for Fox Street is required (see <br />discussion), this would result in a zero setback between the <br />mound systems and the right-of-way instead of the required 20' <br />setback. The applicant was advised of this as soon as the <br />Engineer's recommendation was received, but chose to not provide <br />additional testing to show how such a right-of-way dedication <br />might be accommodated, on the basis that he opposes any <br />dedication of additional right-of-way. <br />The site evaluator has verbally indicated to staff that the <br />right-of-way dedication would likely force the use of a site with <br />slopes in the range of 8%, a variance from the septic code <br />maximum of 6%. Staff would note that the applicant's surveyor <br />was advised that if dralnfield sites required a slope variance, <br />we would request topography of the entire parcel as a means to <br />review all other possibilities. <br />NDSA indary <br />The MUSA boundary currently is located 330' east of the <br />center line of Orono Orchard Road, placing the existing residence <br />within the Metropolitan Urban Service Area, the westerly portion <br />of the property being outside the MUSA line. <br />Sewer Availability <br />The existing residence at 1385 Fox Street was provided with <br />municipal sewer as part of the 1980—1 "Minnetonka Bluffs" <br />project, and is connected to the sewer. A municipal lift station <br />serving the Bluffs area and Woodhill Country Club exists at the <br />easterly tip of the property on an easement. The survey suggests <br />that the control panel for the lift station may be encroaching <br />past the easement boundary, although no dimension for such <br />encroachment is provided on the survey.
