I! <br />MINUTES OF THE PLANNING COMMISSION MEETING FEBRUARY 20, 1990 <br />#1490 K-P PROPERTIES CONT. <br />Mabusth said that she was not aware of a policy regarding <br />public maintenance of roads privately owned. Mabusth noted that <br />at the sketch plan review of this matter, it was suggested that <br />the right-of-way shown came from the east property. That theory <br />has been disproved by the City Attorney. The road was previously <br />known as County Road 43 or Town Road, and was vacated. The <br />specific road corridor was created by former owner, who owned all <br />of the land in the area, for access to North Arm Drive. Mabusth <br />also informed the Planning Commision that North Arm Lane does not <br />directly intersect with North Arm Drive. There is a private <br />property area over which everyone must have an easement in order <br />to access their properties. The City, by maintaining the road <br />for many years, would now define the road as a public road. <br />Kelley asked whether the City would take right-of-way from <br />the west side at the time of subdivision if it obtains additional <br />right-of-way from the east side? <br />Mabustn replied that the City will acquire enough width to <br />make up a 50' right-of-way. <br />Bellows noted that taking the right-of-way from the east <br />side will not render the lot unbuildable, it will only limit the <br />size of house that can be built. <br />Kelley noted that the Planning Commission is also being <br />asked to recommend approval of a 62% lot width variance for Lot <br />2. <br />Bellows asked if taking 8.5’ of right-of-way from the east <br />side would still impact the septic site? <br />Gaffron replied that there is no leeway at all. <br />Hanson asked whether it would be possible for Mr. Peterson <br />to obtain additional property? <br />Mabusth replied that Mr. Peterson has tried to work with an <br />adjacent property owner to no avail. <br />Mr. Peterson explained that should that property owner agree <br />to provide additional land to him, it may jeopardize their <br />potential future septic sites. <br />Mr. Mark Larson, 366 North Arm Lane, asked how the City came <br />to own North Arm Lane? <br />4 <br />....in..
