(W5-3I49 <br />September 19,2005 <br />Pace 6 of 7 <br />ImiMcts to Adjacent Property Owners <br />The nearest property owner is to the west at a distance of approximately 250*. This site is <br />a group home (also operating under a conditional use permit) and would not be <br />negatively impacted by the proposed expansion as most of the improvements are on the <br />east side of the property. <br />The property owner to the east is a residential home, currently 360* from the church. The <br />extent of the parking lot currently reaches to a distance of approximately 100* to the <br />house, with the closest location being where the Wolsfeld Woods public entrance is <br />located. The proposed addition would bring the church a distance of approximately 320’ <br />from the house to the east. The proposal will not add any negative impacts as no parking <br />lot lighting is imposed and any building mounted lighting will be directed downwards <br />and is probably too great a distance away for that lig? t to even reach the property line. <br />Lastly, there are three residential homes to the south, on the south side of Sixth Avenue <br />N. These homes range in distance from 390* to 490* from the front fa9ade of the existing <br />church. Staff docs not foresee any negative impacts resulting to these properties with the <br />proposal. <br />CUP Standards <br />In accordance with Section 78-916 (a) (1-3), the Planning Commission may recommend <br />and the Council may grant a conditional use permit as the use permit was applied for or <br />in modified form, if on the basis of the application and the evidence submitted the City <br />makes the following findings: <br />(I) That the proposed location of the conditional use is in accord with the objectives <br />of this chqiter and the purposes of the district in which the site is located and the <br />conqpreheiuive municipal plan; <br />The proposed expansions to the conditional use are in accordance with the <br />Municipal Code as churches are listed as a conditional use in the “R“ districts. <br />The proposed expansions are to a use considered historical on the property and, <br />in general, within the requirements of the Zoning Ordinance. <br />That the proposed location of the conditional use and the proposed condition <br />under which it would be operated or maintained would not be detrimental to the <br />public health, safety or welfare, or materially injurious to properties or <br />improvements in the vicinity; and <br />The proposed conditional use would not be detrimental to public health, safety or <br />welfare. The property has been used as a church since prior to 1970. <br />(3) That the proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br />The single piece of the proposal not complying with cqtplicable codes is the <br />—•-J
