My quaaiiona ace aa follows: <br />1) How was tha municipal lot obtained, by purchaie or dedication? From <br />whom and when? If purchaaad how much was paid? Who mainuins it <br />(plowing, twaeping, striping, repairs, etc.)? Do tha businesses that benehi <br />pay for the expanse? Wte insures it and has liability on the property? <br />2) With regard to the many variancea sought please describe in detail the <br />City's Afutinp of hardship for each in accordance with applicable law. <br />3) With regard u p«king plaaae indicate whether the City will be properly, <br />in accordance with City Code, developing a parking lot stripirtg layout <br />with legal dimensioae in order to dctamine dm true number of spaces <br />provided in the municipal lot <br />4) Pteaaa ad vise as to the Lot Coverage if the approved patios are included m <br />the *^^>mpi*tstiffft <br />5) The siu plan shows trees in the sidewalk. Also, any police records <br />detailing enforcement of traffic laws for illegal motorcycla mufflcri in the <br />vicinity. Where can these be viewed? <br />IndicMe if there is precedent elsewhere in the City for coUcciivc excuses <br />from codes, laws and orditumcea being sought by the applicant and whae. <br />It was reported that the Saloon has a great and positive economic impact <br />on the Navane area and ihat people spend their money m Navarre, thus <br />benefiting the noghborhood Please advise if the City has any facmal <br />information in this regard <br />The applicant stated that the expansion is for family dinner sealing at low- <br />top tables and not for expansion of the bar They then admitted that they <br />will be serving alcohol in all areas - including outside, la thia allowed by <br />City or State law? <br />Has the City requested - or been furnished - a breakdown of Saloon sales <br />as to food and liquor percentages as is customary when considering liquor <br />applicatioDS? <br />Neighbor cities such as Excelsior have had a gioat deal of experieiKe with <br />this type of use adjacent to residences The former Mai-Tti and Maynard’s <br />in particular. Ihese ban were required to shut down outside music <br />(speakers included) at 10 00 p4u. Why is the staff not recommending <br />similar restricijona? <br />At a retident with small children I am personally appalled at the total <br />disregard by the Planning Commission for our concerns Clewly Ihe desire <br />to have a place to consume alcohol, smoke and then depart in a motorized <br />vehicle to pet our children atrisk is a major goal for the City OfOrono, as <br />evidenced by those in sUciidatKe I was particularly thankful for being <br />allowed to suy over four hours to listen lo testimony fiom Watertown <br />lesidenu who own no property m Orono as to why I should move <br />soaewhere else if 1 don't like the noise. I have, m fact. Uved on Kelly <br />Avenue for over a decade end LONG before the Saloon was approved. <br />As a reel cstau developer with knowledge ofzoning laws I am intrigued <br />by the City's complete disregatd for vanance justificaucn, particulaily
