i <br />#05-3132 <br />July 18,2005 <br />Past 5 of 6 <br />Conditional Use Permit Analysis <br />The applicants have proposed to incorporate approximately 900 cubic yards of Hll on t!;** <br />road side of the proposed home. The Shoreland Overlay District requires that a <br />conditional use permit be reviewed for any fill in excess of 500 cubic yards outside the 0- <br />75' zone. Zoning Ordinance Section 78-1250 provides the following evaluation criteria <br />for requested conditional uses within the Shoreland Overlay District: <br />(1) Evaluation criteria. A thorough evaluation of the water body and the <br />topographic, vegetation and soils conditions on the site must be made to <br />ensure: <br />a. <br />b. <br />The prevention of soil erosion or the possible pollution of public <br />waters, both during and after construction; <br />The applicant will not be permitted to grade within 75 ’ of the lake <br />and a silt fence inspection will be required prior to any site <br />grading. Because the proposed fill will be placed on the street side <br />of the proposed home, staff feels there isn 7 any gi'eater risk of <br />possible pollution to the lake. <br />The visibility of structures and other facilities as viewed from <br />public waters is limited; <br />The applicant's builder has indicated the views from the lake will <br />not be affected by the proposed fill to be placed on the .street side <br />of the lot. <br />c. <br />d. <br />The site is adequate for water supply and on-site sewage treatment; <br />and <br />Not applicable as the site is served with municipal sewer. <br />The types, uses and numbers of watercraft that the project will <br />generate are compatible in relation to the suitability of public <br />waters to safely accommodate these watercraft. <br />Not applicable. <br />The need for the fill arises because the lot exists as a walk-out to the street side, with a <br />partial walk-out to the lake. The effects of the reverse walk-out scenario is that the views <br />fixim the lake will be minimally, if at all, impacted and views from the road entering into <br />the site will be dram .4tically raised whereby a driveway sloping up towards the house will <br />be artificially made. The previous house utilized a tuck-under style garage with a flatter <br />driveway giving in to the topography of the lot. <br />The City Engineer has reviewed the proposed grading plan and is recommending the <br />applicants plan accordingly for the approximate 90 truckloads to be brought onto the site <br />and that the applicants be sure to not disturb the grades within 26' of the wetland. The <br />building department has indicated that a silt fence would be required to be installed at the <br />26* wetland setback to ensure the least amount of disturbance. Beyond those concerns.
