V <br />/r <br />4. <br />5. <br />The Planning Commission reviewed this application at a public hearing <br />held on June 20, 2005 and recommended approval of the conditional use <br />permit and variance based on the following findings: <br />a. The upper level office proposed will have no negative impacts on the <br />surrounding area. <br />b. The proposed wrought iron staircase consisting of materials <br />comparable to the main building will reduce the negative visual <br />impacts as viewed from the north side of the building. <br />c. The staircase cannot be moved interiorly due to Building Code <br />conflicts. <br />d. The proposed staircase will have a greater setback from Lyric Avenue <br />than the handicap ramp, located on the west side of the site adjacent to <br />the City-owned parking lot. <br />e. The AC unit, gas meter and dumpster enclosure will also be located on <br />the north side of the building, fiirther hindering an unobstructed north <br />side street yard. <br />f. The original Lyric Avenue setback was IS* prior to removal of the <br />screen porch and shed. <br />The City Council has considered this application including the findings <br />and recommendation of the Planning Commission, reports by City staff, <br />comments by the i^>plicants and the public, and the effect of the proposed <br />conditional use pormit variance on the health, safety and welfare of the <br />community. <br />The City Council finds that the conditions existing on this property are <br />peculiar to it and do not apply generally to other property in this zoning <br />district; that granting the conditional use permit and variance would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard or other <br />danger to neighboring property; would not merely serve as a convenience <br />to the applicants, but is necessary to alleviate a demonstrable hardship or <br />difficulty; is necessary to preserve a substantial property right of the <br />Page 2 of5
