'r- i \ <br />:«v . ■■ ; '•v\.f^.v; <br />‘O'V <br />A RESOLUTION GRANTING A <br />CONDITIONAL USE PERMIT AND A <br />SIDE STREET SETBACK VARIANCE <br />PER MUNICIPAL ZONING CODE <br />SECTION 78^ (8), 78^ (E) <br />RLE NO. 05-3125 <br />WHEREAS, Christine Valerius and Philip Fisk, husband and wife <br />(hereinafter **the applicants”) are the owners of the property located at 2377 Shadywood <br />Road within die City of Qrono (hereinafter the “City”) and legally described as follows: <br />Lot S, Block 3, Townsite of Langdon Park, Hennepin County, Minnesota <br />(hereinafter the “property”); and <br />WHEREAS, the applicant has made application to the City of Orono for a <br />conditional use permit and side street setback variance to Orono Municipal Zoning Code <br />Sections 78-644 (8) and 78-646 (E) to allow parts of the upper level of the existing <br />building and addition currently under construction to be used as office not accessory to <br />the approved coflee shop/restaurant, and for access to this upper level office through a 2"** <br />story exterior wrought iron staircase to be located on the north side of the lot at a setback <br />of 21.5’ where a 35’ setback is normally required, 24’ was previously approved and 15’ <br />existed prior to the coffee shop use. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. <br />2. <br />This iqiplication was reviewed as Zoning File 05-3125. <br />The property is located in the B - 1, Retail Sales Business District which <br />requires a minimum lot area of 20,000 s.f. and a minimum lot width of <br />100 feet The property is 10,350 s.f in area and 90 feet in width. <br />Page 1 of 5 <br />■ -I
