i <br />1 <br />conditional use permit requests, as outlined in Section 78-916: <br />(1) That the proposed location of the conditional use is in accord with the objectives of <br />this chapter and the purposes of the district in which the site is locatni and the <br />comprehensive municipal plan; <br />The proposed office is allowed under the B - I zoning district as a conditional use. <br />The Planning Commission should determine if the proposed office is in accordance <br />with the objectives of the Navarre area in mating a recommendation. Stafffinds that <br />the Navarre area does contain districts zoned for office use, therefore the proposed <br />office would be acceptable for the Navarre area <br />That the proposed location of the conditional use and the proposed condition under <br />which it would be operated or maintained would not be detrimental to the public <br />health, safety or welfare, or materially injurious to properties or improvements in the <br />vicinity; and <br />Stiff finds the proposed office would not impact the public health, safety or welfare. <br />That the proposed conditional use will comply with each of the applicable provisions <br />of this duqrter. <br />The proposed use would comply with the applicable provisions of the Zoning <br />Ordinance, with the exception of the side street setback variance of which staff is <br />recommending denial of. <br />The Planning Commissicm voted 5-1 in &vor of the office use. The Council should determine if the <br />proposed office use above the jneviously apimived coffee shop, as outlined in the applicant’s <br />narrative in Exhibit A, would comply with the three (3) conditions noted above. <br />COUNCIL ACTION REQUESTED <br />Direct staff to draft a resolution approving or denying the request for a conditional use permit for <br />office in a B -1 district
