The Planning Conunlsslon shall consider reconunendlng approval for variances <br />frim the Meral provbhns of the Zoning Code In Instances where their strict enforcement would cause <br />undue hardship because of circumstances unique to the Individual property under consideration, and <br />shall recommend approval only when It Is demonstrated that such actions will be In keeping with the <br />spirit and bitent of the Orono Zoning Code. <br />Required lot width for the LR-IB District is 140’, and an existing lot of record in R <br />districts of one acre or less meeting 80% of the lot area and width standards is allowed to <br />be residentially developed. The 80% of width standard for a lakeshore lot must be met at <br />the OHWL and at the 75 ’ setback line. In this case, the lot exceeds 140’ in width for <br />most of its length, as well as at the building location, bu< narrows to 106’ defined width at <br />the shoreline, not meeting the 80% standard (106/140 => 76%). <br />This lot has been vacant since 1995, and although the current property owner has made a <br />number of inquiries in the past months about aspects of building on the lot, the lot width <br />issue was not discovered until the end of the CUP and hardcover variance review in May <br />2005. The lot can be developed to meet all other City requirements, and no additional <br />land is available to make the lot width conforming.
