Gappa <br />THIc Director of Public Services <br />Administrator Reviewed: Agenda Section: <br />} Public Services Director's Report <br />Item Descriptiott: Approve Eminent Dom^n Settlement Baldur Park Drainage Easement <br />Phase 1 of the Birch Lane/ Baldur Park Road drainage project was constructed in 2004. This project <br />was to install concrete curb and gutter and catch basins on Birch Lane. The street was crowned, so <br />the water drains along the curb and gutter into two catch basins at the Birch Lane/ Baldur Park Road <br />intersection. The water from the catch basins on both the north and south sides of Birch Lane now <br />drains south to Crystal Bay. <br />Phase 2 of this project is to construct a pipe and swale system to drain the water from the north side <br />of Biieh Lane to North Arm Bay which would provide for filtration of the stormwater through a <br />large wetland before discharge into the lake. This project includes the irwtallation of a 10” pipe in <br />the City right of way on the west side of Baldur Park Road to a point 150 feet north of the <br />intersection and then construction of a drainage swale because the ground elevations are too low to <br />continue the pipe. The swale would continue north along the road right-of-way and then cross a <br />small privately owned vacant unbuildable parcel to drain the water into the wetland adjacent to North <br />Arm Bay. Construction this swale will require the City to obtain a drainage easement. <br />The City initially offered the property owner $1,500 for the drainage easern'TiC. The property <br />owner rejected the City ’s offer, so an appraisal was completed that set a value of $1,600 for the <br />drainage easement. The property owner then requested that the City purchase the entire parcel at <br />a cost of $16,000. On December 13,2004, the Council approved a resolution authorizing the City <br />to begin eminent domain proceedings to acquire the drainage easement. The City attorney has <br />reached a settlement agreement with the property in the amount of $3,500 for the drainage <br />easement. <br />The staff recoirunendation is for the City to accept the $3,500 settlement to Gary Spindler for the <br />Baldur Park Drainage Easement Eminent Domain Proceedings with payment of this settlement <br />from the 2005 Stormwater Fund Budget which will require a budget adjustment. <br />COUNaL ACTION REQUESTED: <br />Motion to approve payment of the settlement in the amount of $3,500 to Gary Spindler for the <br />Baldur Park Drainage Easement Eminent Domain Proceedings from the 2005 Stormwater Fund <br />Budget, and approval of a budget adjustment to reflect this expenditure.
