i V. <br />I <br />A RESOLUTION <br />APPROVING THE PLAT OF <br />STONEBAY THIRD ADDITION <br />> FILE #02-2840 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono (hereinafter “City Council”) has <br />adopted subdivision and land development regulations for the orderly, economic and safe <br />development of land within the City; and <br />WHEREAS, the City Cou..cil has considered the application by John Terrance <br />Homes LLC, a Minnesota limited liability company (hereinafter “Owner”), and OT Development <br />LLC, a Minnesota limited liability company (hereinafter “Developer”) for final platting and <br />development by the Planned Unit Development process of property legally described as follows: <br />Outlot G, STONEBAY, Hennepin County, Minnesota <br />(hereinafter “the Property”); and <br />WHEREAS, on January 27, 2003 the City Council adopted Resolution No. 4915 <br />granting General Development Plan Approval and Preliminary Plat Approval for the development <br />known as Planned Unit Development No. 4 (PUD No. 4), which approval resulted in the following: <br />1. Creation of Outlot G, STONEBAY for future phased development for residential <br />uses; <br />2.Rezoning of Outlot G, STONEBAY to RPUD Residential Planned Unit Development <br />District per Ordinance No. 225,2nd Series adopted May 12,2003; and <br />3. Establishment of conditions for development within PUD No. 4; and <br />' i •• <br />WHEREAS, the Owner or its predecessor in title executed the Planned Unit <br />Development No. 4 Agreement which set forth terms and conditions for the development of PUD <br />No. 4 which includes Outlot G, STONEBAY, providing for the installation of certain public and <br />private improvements, and which agreement documents the general and detailed conditions for use <br />and development of the Property, including the future platting of the Property into Lots, Blocks and <br />Outlets; and <br />Page 1 of 4
