J <br />That the proposed location of the conditional use is in accord with the <br />objectives of this chapter and the purposes of the district in which the site <br />is located and the comprehensive municipal plan; <br />The proposed office is allowed under the B-1 zoning district as a <br />conditional use. The Planning Commission should determine if the <br />proposed office is in accordance with the objectives of the Navarre area in <br />making a recommendation. Staff finds that the Navarre area does contain <br />districts zoned for office use, therefore the proposed office would be <br />acceptable for the Navarre area. <br />That the proposed location of the conditional use and the proposed <br />condition under which it would be operated or maintained would not be <br />detrimental to the public health, safety or welfare, or materially injurious <br />to properties or improvements in the vicinity; and <br />Staff finds the proposed office would not impact the public health, safety <br />or welfare. <br />That the proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br />The proposed use would comply with the applicable provisions of the <br />Zoning Ordinance, with the exception of the side street setback variance of <br />which staff is recommending denial of. <br />\ ■ <br />Baaed on compliance with the conditions notes above, staff finds the proposed accessory <br />ofBce would be in keeping with the spirit and intent of the Zoning Ordinance. <br />IssMs for Consideration <br />1. Is there a hardship to allow a further encroachment of the side street setback? <br />2. Are diere alternatives to the proposed staircase? <br />3. Would the private office use have any negative impacts? <br />4. Are there any other issues or concerns with this application? <br />Staff Rcconinicndation <br />Staff recommends: <br />1. Approval of the conditional use permit amendment to allow the upper level of the <br />new addition to be used as office of a general nature as no negative impacts result <br />with that use. <br />2. Denial of the side street setback variance to allow a further encroachment of the <br />side street of Lyric Avenue, as there arc alternatives to the proposed exterior <br />staircase.
