The applicants <br />are proposing to remove their existing garage roof, and construct a new roof matching the <br />home, with a steeper pitch. <br />Hardcover Variance <br />This property has 0-75’ setback zones on each end. Both 0-75’ zones contain non- <br />conforming hardcover. The zone to the east contains over half of the existing home, <br />sidewalk and a grade-level deck, while the zone to the west contains the property ’s <br />driveway and garage. Removals were required in conjunction with approval for the <br />previous application to change the pitch on the home. Additionally, the applicants were <br />required to remove the encroachments on the neighboring property. <br />Hardship Statement <br />Applicant has completed the Hardship Documentation Form attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br />Hardship Analysis <br />Iw ctHnUerbig apptk»th$u for vortoiice, the Planoiag CommluiOH shall consider the effect of the <br />proposed variance upon the health, safely and welfare of the conmninliy, existing and anticipated tra/fk <br />conditions, light and air, danger of fire, risk to the pnhik safely, and the effect on valnes of property In <br />the snrronnding area. The Planning Commission shall consider reconnnending approval for variances <br />ftom the literal provisions of the Zoning Code In Instances where their sirkt enforcement would cause <br />undue hardsh^ because of circumstances unique to the Individual property under consideration, and <br />shall recommend approval only when h Is demonstrated that such actions will be In keeping with the <br />spirit and Intent of the Orono Zonbtg Code. <br />Staff finds that due to the location of the existing garage, and location of the 0-75’ zones <br />on this property, there may be hardships to Justify granting variances for this project.
