A RESOLUTION GRANTING <br />PRELIMINARY APPROVAL OF A <br />CLASS 111 SUBDIVISION FOR <br />PROPERTY LOCATED AT <br />801 TONKA WA ROAD <br />FILE NO. 05-3073 <br />WHEREASy David R. Pomije and Joann Pomije (hereinafter the “subdividers”) <br />on December 20, 2004, filed a formal subdivision application with the City for approval <br />of a two lot residential plat of property legally described as: <br />Lot 1, Auditor’s Subdivision No. 217, Hennepin County, Minnesota <br />(hereinafter “the property”); and <br />WHEREASy after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono’s lining and Subdivision Codes, the <br />Orono Planmng Commission held a public hearing on April 18, 2005, at which time all <br />persons desiring to be heard coiKeming this application were given the opportunity to <br />speak thereon; and <br />WHEREASy at their regular meeting held on May 9, 2005, the Orono City <br />Council considered the subdivision application of the subdivider noting the following <br />fifKiings of fact: <br />1.The property is located within the LR - IB One Family Lakeshore <br />Residential Zoning District requiring a minimum of 1 acre of contiguous <br />dry buildable land within each newly created lot. <br />2.The property contains a total of approximately 3.55 acres of land. There <br />are no wetlands on the property. <br />3. <br />-- <br />The proposed plat consists of two residential lots each meeting the <br />minimum lot standard requirements of the LR - IB, One Family <br />Lakeshore Residential Zoning District, each meeting the minimum 1.0 <br />acre lot area requirements and each having over 140’ in defined width at <br />the shoreline and 75’ setback. <br />Page 1 of 5 <br />4
