The nature of the topography on this <br />property’s lake yard is very challenging, and a stair system is necessary for the <br />homeowner to access the lake. <br />The existing cinder block wail, stairs, and landings within the 0*75’ setback zone <br />constitute 4.6% hardcover. The proposed stair system and re-grading of the slope to <br />eliminate the timber wall and replace with short boulder walls will be a minor reduction <br />in hardcover with 4.5%. The proposed stair and boulder wall system when the installed <br />vegetation fully matures will be less visible and more natural looking when viewed from <br />the lake than the existing wooden stair. <br />Hardship Aaalysis <br />In coHsUerlng n/tpUenHoHM for vnHnnce, the Planning ConuniMSion shall consider the effect of the <br />proposed variance npon the health, spfety and welfare of the conununlly, existing and anticipated traffic <br />conditions, light and air, danger of fire, rish to the pnhUc safety, and the effect on values of property In <br />the surrounding area. The Planning Connnisslon shall consider reconunendlng approval for variances <br />from the literal provisions of the Zoning Code In Instances where their strict enforcement would cause <br />undue hardship because of etrcnmstances unique to the Individual property under consideration, and <br />shall reconunend approval only when it Is demonstrated that such actions will be In beeping with the <br />spirit and Intent of the Orono Zoning Code. <br />Staff finds that a hardship exists due to the challenging lakeshore portion of the lot and <br />the need for the hardcover (stairs), justifies granting the variance request for the change <br />in hardcover.
