Council Minutes from 12-13-04 <br />Application Summary: <br />Applicants are requesting after-the-fact approval of a conditional use permit in order to construct a <br />boulder wall, re-pnde the lake yard, and a hardcover variance due to the increase in the hardcover <br />percentage with the square footage from the proposed rock walls. The applicant is proposing to <br />increase the hardcover within the 0-7S* zone from 7.84% to 8.7% (or 134 s.f. ^ditional). <br />This application was tabled at the December meeting in order to allow for a site inspection afrer the <br />snow melted to verify hardcover. Staff has conducted the site visit and reviewed the file history. It <br />appears that over the years several applications were made by the previous owner and approvals we <br />granted requiring specific hardcover removals at different times for a gravel driveway, a lakeside deck <br />and grade level lake deck, and a shed. The resolutions granting approvals and requiring removals <br />were not signed allowed to expire, and therefore are not valid. The projects that required those <br />removals were never commenced. <br />Plaaniug Commbsiou Recommendation <br />On November 15,2004, Planning Commission voted 5-2 on a motion to approve the afrer-the-fact <br />conditional use permit and deny the after-the-fact hardcover variance. The recommendation was to <br />allow the most lakeward wall with concurrent 0-75’ hardcover removals and to deny the addition of <br />any other walls except for those determined by the Engineer to be crucial to the integrity of the lake <br />ya^.
