However, in following with the City Engineer ’s recommendation staff feels <br />that the wall and fire pit located in the 0-75 ’ zone should be removed as well. The <br />hardcover within this zone should be removed and re-graded as appropriate. A stairway is <br />allowed for purposes of lake access. <br />Hardship <br />Staff finds that there is no hardship to justify granting a hardcover variance to allow the <br />hardcover within the 0-75 ’ zone, however due to the slope of the lake yard there may be <br />justification to allow a lake access stair to be constructed. <br />Issues for ConsMcnition <br />1. Are there any other issues or concerns with this application? <br />Staff Reconiniendation <br />Planning Staff recommends denial of the after-the-fact hardcover variance for the 0-75 ’ <br />setback zone and qqiroval of a conditional use permit in order to re-grade the lake yard. <br />The applicant should be provided with a timeline for hardcover removals, re-grading and <br />vegetation restoration. Additionally, the ai^licants should provide a re-grading and <br />erosion control plan in a timely marmer for approval and implementation spring or <br />summer 2005 and ^iply for a stair installation permit if they choose to install a stair. <br />i
