The conceptual approval revision consists of a 1,499 square foot building footprint and <br />asso':ialcd hardcover totaling 31.7 percent for the 75 ’-250 ’ /one. A revised vegetation re.storation plan <br />has also been reviewed by the Planning Stafl, the City Engineer, and the adjoining property owner <br />Further rev.sions based on the comments of the various reviewing parlies have been incorpoiulcd into the <br />version of the vegetation restoration plan that will be enforced by the agreement contained in Exhibit F,. <br />.Staff has rec eived a copy of the private agreement between the applicant and the neighboring property <br />owners tliat resolves the illegal tree removal issue by the applicant (»n the neighbor’s property. <br />(Council Member Sanseverc leaves the meeting) <br />Murphy inquired about Item 4-c on page two and exactly what agreement has been reached with the <br />adjacent property owner. <br />Vog.strom indicated his nciglibor requested $9,000 for the lemoved trees, whicli has been conveyed. <br />JcH’Essen, 264K Casco Point Road, indicated an agreement has been signed, with the inclusion of <br />downspouts and gutters along with the rmancial .settlement. <br />Murphy inquired whether both paities feel the agreement has been fidEdled. <br />Vogstrom noted the agreement was fulfilled approximately one month ago. <br />Essen staled he had the understanding that no further trees would be removed from bis propei ty but that <br />within the past week it was necessary to request a tree removal contractor to stop work on his property. <br />Vogstrom slated it is crystal clear that he is not to remove any other trees from the Essen pio|K'rty and that <br />the tree removal contractor was merely removing a live to six foot stump of a tree Uiat had previously <br />been cut down Vogstrom stated it was intended to Ire a kind gesture on his pail. <br />Murphy stated he would not be In support ol the approval resolution due to the proposed footprint. <br />1
