A RESOLUTION GRANTING <br />AMENDMENT NO. 2 TO <br />RESOLUTION NO. 4479 <br />FILE NO. 2587 <br />WHEREAS, on June 12, 2000, the City Council of the City of Orono (the “City") <br />adopted Resolution No. 4479 grunting preliminary approval for platting of a section of public road <br />easement located at 4S7S Wayzata Boulevard approval; and <br />WHEREAS, Resolution No. 4479 required tliat Richard Rudd and Shane Rudd (the <br />‘Applicants") oubniit the final plat for approval no later than December 3 1 ,2003; and <br />WHEREAS, the Minnesota Department of Transportation (“MiiDOT”) has delayed <br />cotislruction of an access road which will serve the Rudd ’s property; and <br />WHEREAS, the Applicants requested and were granted an extension of the effective <br />period of preliminary plat approval to December 31,2004; and <br />WHEREAS, the Applicants have rcque.stcd an additional extension of the effective <br />period of preliminary plat approval to July 3 1 ,2006 as a residt of MnDOT ’s further post|)oncmcnt of <br />the road project. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Orono, Minnesota, as follows: <br />I. The effective period of preliminary plat approval is hereby cMended to July 31, <br />2006;and <br />2.
