GafTron <br />Titk: Planning Director <br />Agenda Section: <br />Zoning <br />Item Description: #05*3083 ProposcfiPfMUSA Amendment, Myrtlewood & 25 S Brown Rd <br />List of Exhibits <br />A - Planning Commission Memo and Exhibits of 2-17-05 <br />Pursuant to published legal notice the Planning Commission held a public hearing on February <br />22"^ and subsequently on a vote of 5-0 recommended approval of the proposed Comprehensive <br />Plan Amendment to add properties in the Myrtlewood Road area and 25 South Brown Road to <br />the Metropolitan Urban Service Area (MUSA) per the attached Memo and Exhibits of 2-17-05. <br />No public comments were received at the Planning Commission hearing. <br />The next step in the process is for the Council to conditionally approve the proposed amendment <br />subject to Metropolitan Council review and comment, and direct staff to submit the amendment <br />to the Metropolitan Council. <br />The property owners in these areas have requested inclusion in the MUSA to provide the option <br />of having sewer (and water for Myrtlewood) installed to serve their properties. Once these areas <br />arc included in the MUSA, the Myrtlewood property owners can then petition the City to <br />complete a project to bring utilities into the neighborhood. This would be an assessment project <br />with the residents agreeing to be assessed for all of the project costs. Sewer service is already <br />available for the property at 25 South Brown Road, and the property owner could connect to this <br />sewer upon cither paying or agreeing to being assessed for the Fox Ridge Project sewer <br />connection charge which is currently $18,485. <br />COUNCIL ACTION REQUESTED <br />Adopt the following motion: <br />Moved by ,seconded by , to conditionally approve 2000-2020 <br />Comprehensive Plan Amendment //3 adding certain properties along Myrtlewood Road and 25 <br />South Brown Road to the defined Metropolitan Urban Service Area (MUSA) subject to review <br />and comment by the Metropolitan Council, and direct staff to submit the amendment to <br />Metropolitan Council.
