e) Outlots A and D idiall not be used except for public recreational trail use until <br />such time that they arc platted into Lots, at which lime their permitted uses will be <br />further designated; except that Outlet A may be used for a temporai7 sales trailer <br />and parking area for the residential portion of development until such time that <br />the trailer can be moved onto the residential portion of the property. <br />f) Outlots B and C shall be used for regional stonnwaler ponding purposes and <br />public recreational trail purposes. No other uses will be pcnnilted for Outlots B <br />and C. Other ir.ses shall not be allowed except by arnendnrent of this PUD <br />agreement. <br />5. Site Access. The only residential access to adjoining public streets .shall be onto Kelley <br />Parkway, except that future developrncirt within Oullol H shall be allowed otre sltared <br />driveway access onto Willow Drive. Access drivewav locations shall be as showrt ort the <br />approved site plan. Exhibit A. A righl-in/right out access from Willow Drive to Outlet <br />A may be ir.sed to access the parking area for the temporary sales trailer until such tiirre <br />that the trailer is moved onto the residential portion of the property. Future long-term <br />access to Outlot A fronr Willow Drive shall be determined at the time Outlet A is <br />developed. Future acce.s.>i to Outlot D shall be solely from Kelley Parkway. No direct <br />access from Outlots A and D shall be allowed to Highway 12. Internal circrrlation for the <br />I’roperly shall be via private driveways, sidewalks and parking areas within the defined <br />common areas. <br />Building Design and Con .stniction . All residential buildings ort the Property shall be <br />constnreted according to frnal plans which shall first be certified by the Planning Director <br />as being in conformity with the approved plans attached as Exhibit <; to ensure <br />compliance with the architectural standards of the RPUl") District. Final decisions by the <br />Developer regarding colors, types and qualities of building materials shall be subject to <br />City staff approval to confirm their conformity with the approved sample colors, types <br />and qualities docurnented by reference in Exhibit (J. <br />Con.sfiiiction of all buildings shall be in conformance with the building codes and <br />regulalimis adopted by the City of Oroi'o. Any substantial changes to the gross square <br />footage, footpiiiit/wall/roof dimensions or defined building heights shall require a prior <br />amendment to this Agreement. “.Sub.stan'ial changes” shall include, but not be limited to, <br />(1) an increase in jposs square footage or footprintAvall/roof dimensions of any unit so as <br />to require a rcplalting to keep the unit within its ownei.ship Ixrt; (2) any increase in <br />building height for rambler townhomo units or two-story townhorne units that would <br />result in the n«;cd f(jr a va'iance to the standard 30' height limit; or (3) a one foot or <br />g.icatcr increase in height of the loll building above the 38' defined height approved per <br />Resolution No. 4915. <br />The separation distances between townhorne buildings shall be a minimum of 15' except <br />where .specifically shown us Ics.s than 15' on the approved Crcncrnl Devclopnicnt Plan. <br />Within each Phase of development, if any change.s to plans result in building separations <br />le.ss limn 15', such plans shall be subject to prior review and approval by the CTly <br />Council. <br />Page 3 of 19 <br />Developer Initial I _
