MINIJTKS OF THE <br />ORONO CITY CTMINCTL MEE1ING <br />Monday, February 14, 2005 <br />7:00 o’clock p.ni. <br />ZONING ADMINISTRATOR’S REPORT <br />4.#04-3052 ERIC VOGSTROM, 2618 CASCO POINI ROAD - VARIANC’ES <br />Fne Vogstrom, Applicant, was present. <br />Curtis addressed the City Council regarding the Vogstrom application, noting that conceptual approval <br />was given at the January City C'ouneil meeting based on reduct ons to the proposed building footprint and <br />hardcover levels, fhe conceptual approval revision consists of a 1,499 square foot building footprint and <br />associated hardcover totaling 31.7 percent for the 75 ’-250 ’ /one. A revi.sed vegetation restoration plan <br />has also been reviewed by the Planning Staff, the City Engineer, and the adjoining property owner <br />Further revisions based on the comments of the various reviewmg parties have been incorjroratcd into the <br />version of the vegetation restoration plan that will be enforced by the agreement contained in F.xhibit E. <br />Staff has received a copy of the private agreement between the applicant and the neighb<iring property <br />owners that resolves the illegal tree removal issue by the applicant on the neighbor ’s property. <br />(Council Member Saiisevere leaves the meeting) <br />Murphy inquired about Item 4-c on page two and exactly what agreement has been reached w ith the <br />adjacent property owner. <br />Vogstrom indicated his neighbor requested $9,000 for the removed trees, which has been conveyed. <br />Jcif Essen, 2648 Casco Point Road, indicated an agreement has been signed, with the inclusion of <br />downspouts and gutters along with the financial settlement. <br />Murphy inquired whether both parties feel the agreement has been fulfill''}. <br />Vogstrom noted the agreement was fulfilled appro.ximately one month ago. <br />Essen slated he hail the understanding that no further trees would be removed from his property but that <br />within the past week it was necessary to request a tree removal contractor to stop work on his property. <br />Vogstrom slated it is crystal clear that he is not to remove any other trees from the Essen property and that <br />the tree removal contractor was merely removing a five to six foot stump of a tree that had previously <br />been cut down. N'ugstrom stated it was intended to be a kind gesture on his juil. <br />Murphy stated he would not be in support of the approval resolution due to the proposed footpnnt. <br />While indicated he would like further clarification on the vegetation restoration plan and agreement with <br />the City. <br />( iailron brietly outlined the proposed vegetation restoration plan, noting that the Plaimmg Staff and the <br />City Engineer have reviewed the plan and leel it is acceptable. <br />PAGE 3
