Gaffron noted final plans <br />responding to City Engineer’s recent comments have been submitted. The City has received letters <br />from two neighboring property owners expressing concerns with this application. <br />Gaffron stated the applicants are proposing a seven lot Planned Residential Development, with the <br />applicant having made the appropriate revisions to the preliminary plat drawing to show the areas to be <br />protected via a conservation easement. The side setbacks for all lots have also been revised to 30 feet to <br />ensure a minimum of 60’ separation between principal structures. Existing trees within the conservation <br />casement areas will be preserved, with the applicant having agreed to walk the site with staff prior to site <br />grading to establish which, if any, trees within the grading area can lie .saved or transplanted. Gaffron <br />stated the applicant is proposing to plant trees every 40 feet along tlic private road as required by City <br />Code and is also proposing additional trees west of lots 1 and 2 in an attempt to begin rc-establishment of <br />the vegetated buffer in this area. <br />Gaffron stated Staff is also recommending pruning of trees and removal of dead wood and damaged <br />branches within the Conservation Easement, with the Homeowners Association being in charge of this <br />area following construction of the development. Gaffron requested the Council discuss tire need for <br />establishing a fund or funding mechanism to help maintain this area in the future by the Homeowners <br />Association. The casement will also include a wood chip path, with the existing bridge in need of <br />replacement, subject to irermits by the appropriate agencies. <br />Gaffron stated the private road accessing this development has been redesigned to be centered on the 40- <br />foot northerly corridor. Gaffron stated the applicant lias concluded in order to achieve the desired water <br />runoff to the NURP pond, curb and gutter is required along the entire length of the private road. In <br />addition, the grading plan indicates that the building pads fur all seven lots will be graded in at the time <br />the home is designed. Gaffron noted it is likely that the elevation of the seven homes will be lower than <br />what was originally proposed given the proposed elevation of the cul-de-sac, which would help to reduce <br />the visibility of the residences. <br />Gaffron stated in regards to stormwater management, preliminary plat approval was granted for seven lots <br />predicated on the applicants’ assertion that the site contains at least 14 acres of non-wetland area and that <br />tire MCWD had accepted the wetland delineation bused on the provided delineation report and the <br />findings of the TEP panel. Tlic final plat .submitted depicts a 40’ by 470’ corridor that was not shown as <br />wetland on any preliminary plat drawings and also was not depicted on any wetland delineation report <br />provided to the City. The app^licant has indicated they arc in the process of filing the required <br />wetland/buffer easements with Hennepin County to meet MCWI) requirements. Gaffron noted no <br />provisions have been specified in tire covenants for maintenance of the stormwater jxrnds. <br />Gappa stated to his understanding in the City’s previous subdivisions the homeowners associations have <br />Irecn icsjronsible for maintaining the NURP ironds. <br />Gaffi on indicated that language would need to be added to the covenant agreements. <br />Gaffron indicated there are a number of issues Staff has regarding the developers agreement.
