r ^ in <br />CITY OF ORONO <br />IIKNNF.IMN COUNTY, MINNESOTA <br />DEVELOPER’S AGREEMENT FOR <br />CREEKSIDE IN ORONO <br />BY <br />CREEKSIDE IN ORONO, LLC <br />THIS AGREEMENT, made and entered into this day of January, 2005, by <br />and between the City of Orono, a municipal corporation orj^^ani/ed under the laws of the Stale of <br />Minnesota (licreinaner called “City"), and Creekside In Orono, LLC, a Minnesota limited <br />liability company, its heirs, organized under the laws of the successors aiul assigns, (hereinancr <br />called “Developer"). <br />WITNESSETH: <br />WHEREAS, the Developer has made application to the City Council for approval of the <br />final plat of Creekside in Orono. <br />AND, WHEREAS, the (’ity Council has granted approval for such development on the <br />condition that the Developer enter into this agreement to provide for the in.stallation of <br />improvements hereinafter de.scribed on the terms and conditions hereinafter set forth. <br />NOW, THEREFORE, in consideration of the premises and of the mutual promises and <br />conditions hereinafter contained, it is hereby agreed as follows: <br />1 • frotierty jjeseription: Lots 1 -7, Block I, Outlot A, Outlot B, Creekside in Orono, according <br />to the recorded |)lat thereof. <br />2.
