A house has existed on Lot 3 since prior to tlic I950 ’s. <br />c. The existing home, which will be removed, is non-conlbrming with <br />respect to the 75 ’ setback from the lake and also hardcover within 75' <br />of the lake. <br />d. I'hc conditional use permit request is merely to remove the existing <br />residence Ikiiiic and restore the site. <br />c. The proposed home will meet all setbacks, lot coverage, hardcover and <br />building height regulations. <br />f. I he two lots will be legally combined in order to be considered as a <br />single parcel for zoning purposes. <br />The City Council has considered this application including the findings <br />and recommendation of the Planning Commission, reports by City stalT, <br />comments by tlic applicant and the public, and the effect of the proposed <br />variance and conditional use permit on the health, .safety and welfare of <br />the community. <br />'fhe City Council finds that the conditions existing on this property are <br />peculiar to it and do not apply generally to other property in this zoning <br />district; that granting the variance and conditional use permit would not <br />adver.sely afiect tralfic cmiditions, light, air nor pose a fire hazard or other <br />•langcr to neighboring property; would not merely .serve as a coinenience <br />to the applicant, but is nece.s.sary to alleviate a demon.strable hardship or <br />difficulty; is necessary to pre.servc a substantial property right of the <br />applicant; and would Ik* in keeping with the .spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />Page 2 of 6
