A RESOLUTION GRANTING VARIANCES <br />AND A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTIONS 78-330 (B) AND 78-1250 <br />FILE NO. 05-3076 <br />WHEREAS, Gregory D. Gustafson and Jeanne S. Gustafson, husband <br />and wife (hcrcinaAcr “the applicants”) are tlie owners of tlie property located at 1280 and <br />1290 Spruce Plan within the City of Orono (hereinafter the “City ”) and legally described <br />as follows: <br />Lot 3, Block 10, SAGA HILL RHVISED, Hennepin County, Minnesolu <br />I-ot 4, Block 10, SAGA HlLl. REVISED, Hennepin County, Minnesota <br />(hereinaOer the “property”); and <br />WHEREAS, the applicants have made application to the City of Orono <br />for variances and a conditional use permit to Orono Municipal Zoning Code Sections 78- <br />330 (B) and 78-12S0 to allow construction of a new residence on an existing lot 0.42 <br />acres in size when 1.0 acres is normally required, 100 feet in width at the shoreline and <br />75 foot setback when 140’ is normally required, and a conditional use permit to allow <br />grading within 75 feet of the lake in order to remove the existing home and restore the <br />site to match the existing grades and to remove the existing retaining walls. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. <br />2. <br />Tliis application was reviewed as Zoning Pile /f05-3076. <br />The property is located in the LR - 1B, One Eamily Lakcshorc Residential <br />District, which requires a minimum lot area of 1.0 acres. <br />3.The Planning Commission reviewed this application at a public hearing <br />held on January 18, 2U05 and recommended approval of the variances and <br />conditional use permit based on the following findings; <br />Page 1 of 6
