ANIMAL CONTROL CONTRACT Continued <br />An "emergency call-out" is defined as a specific request for animal control ser\'ice during limes <br />that an officer is not on duty. If an Orono Animal Control Officer is on duty, even though not <br />patrolling in TONKA BAY, said officer will respond. If deemed appropriate by the Orono <br />officer on call, a situation may be dealt with over the phone. <br />ORONO agrees to coordinate services with the Paws, Claws, and Hooves, 10500 Great Plains <br />Boulevard, Chaska, MN, 55318, which will serve as the impound facility, as long as this <br />arrangement is agreeable with Paws, Claws and Hooves. TONKA BAY agrees to be billed <br />directly by Paws, Claws and Hooves, and to pay for impound, boarding, euthanasia, disposal, <br />or any other veterinary fee as charged by the impound facility. When requested, the Animal <br />Control Officer will review these bills to determine if the charges appear proper. <br />7. ORONO shall furnish monthly reports to TONKA BAY reflecting the charges for animal <br />control services, which each city agrees to pay ORONO within 30 days of being billed. <br />8. When an animal is impounded pursuant to this animal control contract, said animal shall be <br />held in accordance with Minnesota Statute 35.71. In the event that an impounded animal is <br />unclaimed, the animal becomes the sole responsibility of Paws, Claws and Hooves to be <br />placed or disposed of at their discretion. <br />9. ORONO shall maintain reports on Orono forms, or utilize specific fonns as requested by <br />TONKA BAY. A monthly report of activity shall be provided to TONKA BAY. <br />10. The City of ORONO will indemnify and hold hannless TONKA BAY for claims, suits, <br />actions, damages and loss arising out of the negligence or mi.sconduct of the City of ORONO <br />in conjunction with this agreement. <br />11 . TONKA BAY agrees to pay ORONO for services in the perfomiance of this contract, pursuant <br />to Paragraph 1 5 of this contract, as follows; <br />A) Atuuial Fee for patrol and emergency pick-ups...........................$6,042.78 <br />B) Price per deceased animal disposed of by the City <br />of ORONO (does not include deer).....................$50.00 <br />C) It is agreed that if the designated boarding facility or euthanasia/disposal sen ice is <br />unavailable, TONKA BAY shall authorize ORONO to obtain these scr\ ices elsewhere, <br />and TONKA BAY shall pay ORONO the rates of the alternative facility. <br />Aiwml 05 ib^
