ANIMAL CONTROL CONTRAC F <br />Tills aiMccmcnt iiuulc this day of _, 2004, by and between the City of Orono, <br />hereinafter refened to as "ORONO"; and the City of TONKA BAY, licrcinaficr icfcned to as <br />TONKA BAY, witnesseth; <br />In consideration of the co\ cnants and agreements liercinafter set fortii, it is nuitually agreed by and <br />between the parties liereto as follows: <br />1. This agreement shall be effective as of January 1. 2005, and shall continue in effect until <br />December 31, 2005, unless cancelled pursuant to this agreement. <br />2. ORONO agrees to patrol the public streets of TONKA BAY, in accordance with a schedule <br />provided by ORONO, agreed upon by TONKA BAY. If necessary, ORONO agrees to <br />trunspoil animals as it deems appropriate. ORONO will, at the completion of each regular <br />patrol or as soon as reasonably possible, m the City of TONKA BAY, give a written statement <br />to the South Lake Minnetonka Public Safety Department setting foiih a de.scription of all <br />animals impounded including breed, color, weight, name ofowner, name of animal, if known, <br />and point of collection by the patrol officer. ORONO will also attempt to notify South Lake <br />Minnetonka Public Safety Department prior to impounding any animal. <br />3. ORONO agrees to provide personnel and equipment to provide animal control services. Said <br />employees shall perform their duties in proper attire, utili/ang a marked Orono Public Safety <br />vehicle whenever available. These employees shall be in unifonn or have City of Orono <br />identification. <br />4. TONKA BAY shall authorize ORONO to apprehend and retain domestic animals and/or issue <br />citations or warnings for violations of city ordinances. Wild animals shall only be dealt with <br />pursuant to ORONO’S policy regarding wild animals if the animal is presenting dangers of <br />personal injury or significant property damage. However, ORONO shall not invade private <br />property contrary to the wishes of the owner of saiil property, nor forcibly take an animal from <br />any person without the approval and assistance of a peace officer having jurisdiction in that <br />city. <br />5. ORONO agrees to patrol the public streets of TONKA BAY and respond to animal control <br />calls in TONKA BAY. Oiono shall also conduct annual kennel and stable inspections. These <br />shall be scheihiled during regular patrol houis m Tonka Bay. Orono w ill provide an average of <br />22 hours per week of animal control service to the four participating cities. <br />6. In aildition to regular patrol, ORONO agrees to respond to "emergency call-outs" from <br />TONKA BAY. ORONO will have an officer scheduled to respond to such call-outs ORONO <br />shall respond at the earliest opportunity to such requests, including bite ca.ses or injureil <br />animals, as deemed appropriate by ORONO. I'hcrc may be occasions when an animal contiol <br />officer will not be immediately available, in which event the response will occur at the earliest <br />opportunity.
