ANIMAL CONTROL CONTRACT Conlinucd <br />12. LXCliLSlOR shall pay any veterinary bill incurred for unclaimed animals impounded from <br />EXCELSIOR. Owners claijning their animals shall be charged the veterinary bill in its <br />entirety, including impound fees. <br />13. All payments shall be made by EXCELSIOR upon receipt of monthly statements from <br />ORONO with*:! 30 days. <br />Because this is a joint effort involving the cities of SHOREWOOD, EXCELSIOR, TONKA <br />BAY and ORONO, it is agreed upon that any modifications to, or withdrawals fro.n this <br />contract shall require the written authority of each party. EXCELSIOR agrees that in the event <br />that one or more parties seek such change, including withdrawing from the contract, said party <br />(or parties) shall remain obligated to pay their agreed upon annud fee in monthly installments, <br />unless otherwise agreed to by all parties pursuant to this Paragraph, for the remainder of the <br />year. <br />15. EXCELSIOR further agrees ihat ihe fee reflected in this contract is in effect only for the <br />calendar year 2005. <br />16. I hider no circumstances shall ORONO be obligated to respond to any request for assistance, or <br />to patrol when, in the sole discretion of the Orono Police Chief or his duly authorized agent, <br />anyoiicofthe following conditions e.xisf. (1) when necessary personnel and/or equipment arc <br />engaged elsewhere, (2) when road or weather conditions constitute a hazard, (3) when <br />providing assistance would expose any person to unreasonable risks. <br />17.The time and manner in which seivice is rendered, the standard of perfonnance and the control <br />of personnel employed to rerder such scivicc shall be dclermincd by ORONO. ORONO <br />reserves the right to alter scheduling should conflicts arise (i.e. CSO schooling, illness, <br />vacation, etc.). <br />For the City of Excelsior;For the Cilv of Orono: <br /><; <br />L>Tin R.
