• Page 2 CeceTtjer 17.2004 <br />lose your ability to hold a Local Board of Appeal and Equalization effective with the 2005 <br />Local Board of Appeal and Equalization. A local board who forfeits its pov/ers to the county <br />for failing to meet the training requirements may be reinstated by resolution of the governing <br />body of the city or town and upon proof of compliance that at least one member has <br />attended an approved appeals and equalization course. The resolution and proof oi course <br />attendance must be provided to the county assessor by December 1 in order to be effective <br />for the following assessment year. <br />In light of these legislative changes. I want to remind you that M.S. 274.01 subd.3 currently <br />provides for the transference of duties from, the local boards to the county assessor. This <br />slgfuls is only available to those cities whose assessment services are performed bv th^ <br />county assessor. ^ ^ <br />The town board of any town or the governing body of any home rule charter or statutory city <br />may transfer its pov/ers and duties under subdivision 1 to the county board, and no longer <br />perform the function of a local board. Before the town board or the governing body of a city <br />transfers the powers and duties to the county board, the town board or city's governing body <br />shall give public notice of the meeting at which the proposal for transfer is to be considered. <br />The public notice shall follow the procedure contained >c section 13D.C subdivision 2. <br />A transfer of duties as permitted under this suodivision must be communicated to the county <br />assessor, in writing, before December 1 of any year to be effective for the lollowing year's <br />assessment. This transfer of duties to the county may either be permanent or for a specified <br />number of years, provided that the transfer cannot be for less than three years. It.'f length <br />must bo stated in writing A town or city may renew its option to transfer.
