Zoning File #1457 <br />March 14, 1991 <br />Page 7 of 8 <br />As already noted in the earlier review per DNR classification, <br />the wetland type is classified as a Type 6 and 7 and is not a DNR <br />protected wetland. The proposed land alterations must be reviewed <br />once again by the Minnehaha Creek Watershed District and the Corps of <br />Engineers. It is staff's understanding that Mr. Carlson is working <br />closely with the Corps seeking approval of the proposed filling and <br />grading activities within the protected wetlands. Staff has no <br />information as to the current status of those discussions. The Corps <br />may issue a permit allowing 10,000 s.f. of a wetland to be filled <br />under a national permitting system. Anything beyond the 10,000 s.f. <br />area will require more formal review process by the Corps. <br />Review Exhibits G and H, proposed trail. <br />Maximum width at base = 16* <br />Actual travelled trail = 8' <br />As for the portion of the trail that intersects Outlet C, it is <br />staff's understanding that this section is no longer proposed along <br />with the west loop. Applicant proposes the filling of a bermlike area <br />to achieve access to a dry island aj.ea located within the middle of <br />the wetland. The proposed tennis court is no longer planned. The <br />area is to be left in its original state and to merely be used as a <br />hiking and picnic area. <br />To be consistent with the earlier review and directions received <br />from the Minnehaha Creek Watershed District, all fill placed below the <br />970 elevation will be compensated for by matching excavations above <br />the 970 elevation. The question for members for this phase of the <br />review is will you allow a bike trail system through the designated <br />wetland. Is there a difference between approval of private road to <br />achieve access to residential lots and a bike trail installed for the <br />benefit of 12 residential land owners? How do members feel about the <br />installation of the connecting berm to the island within Out lot C? <br />As already noted above, the areas of the bike trail as they <br />intersect residential lots must be excluded from the dry buildable <br />area of each lot. How will the bike trail along the southern <br />boundaries of Lots 1 and 2, Block 2 relate with the private driveway <br />that serves Lot 2, Block 2? WouId you accept a less intense bike <br />trail system within the wetlands area? Would you accept a less <br />intense hiking trail at no more than a 4' width through this unique <br />area? <br />Options of Action <br />Denial. Please refer to the necessary findings in Section 10.55 <br />or tabling until the Corps of Engineers has determined the extent of <br />the filling to allowed within the protected wetlands area.
