Mabusth, Building 6 Zoning Administrator
November 12, 1991
Subject: #1703 Edwin J. and Tracee Gibbs, 1135 Loma Linda
Avenue - Vacation - Public Hearing
Pertinent Ordinance
Section 10.12 - Vacation of Street. As required by the
ordinance, a majority of the land owners abutting the unimproved
20* dedicated road (2 of 3 landowners) have petitioned for the
rezoning. Per Minnesota Statutes a public hearing notice has
been published twice in the official newspaper of this City
commencing weeks of November 4th and November 11th.
List of Exhibits
Exhibit A
Exhibit B
Exhibit C
Exhibit D
Exhibit E
Exhibit F
Exhibit G
Exhibit H
Exhibit I
Exhibit J
- Application
- Petition of Property Owner of
1035 Loma Linda Avenue
- Plat Map
- Property Owners List
-■ Knox Letter - Property Owner 1029 Loma Linda
Avenue
- Warnes Letter 10/6/91
- Survey 1135 Loma Linda
- Survey 1035 Loma Linda
- Survey 1029 Loma Linda
- Staff's Sketch
Description of Request
The applicants have petitioned for the total vacation of the
unimproved right-of-way. Based on the preliminary review of the
surrounding Loma Linda plat, the surveyor had determined that the
total right-of-way of 20' would revert back to the underlying fee
owner supposedly property owners of 1035 and 1135 Loma Linda
(review Exhibit C). It will be necessary for the surveyor to
confirm the recent facts submitted by the property owner on the
west side (1029 Loma Linda) advising that the original land owner
had dedicated 10' of her property along the east property line
some time in 1955 for the purpose of developing a road named
Clara Avenue (review Exhibits E and F) . The original plat of
Loma Linda was filed with the County in August of 1912. It would
also be helpful if the Knoxes could provide an abstract of their
property confirming the transaction some time in 1955. The City
nas no kknowledge of the proposed road Improvement referenced in
the Warnes letter.
.AusjaHiiUuailbi
