ORDINANCE # , SECOND SERIES <br />AN ORDINANCE AMENDING PERPORMANCE <br />STANDARDS TO THE NON-ENCROACHMENT <br />AND ACCESSORY STROCTURE SECTIONS OP THE <br />ORONO MUNICIPAL CODE <br />The City Council of Orono ordains as follows: <br />SECTION 1. Chapter 10 of the Municipal Code of Orono is hereby amended by <br />repealing Sections 10.03, Subdivision 15 A through F, and substituting the <br />following language in its place: <br />Section 10.03, Subdivision 15 - Non-encroachments. The following shall not <br />be considered to be encroachments on yard requirements: <br />A. Chimneys, flues, belt courses, leaders, sills, pilasters, lintels, <br />ornamental features, mechanical devices, cornices, eaves, gutters, and <br />the like provided they do not extend more than 1-1/2 feet laterally <br />into the required yard from a structure that is not located within the <br />required yard. <br />B. Lights for illuminating parking areas, loading areas, or yards for <br />safety and security purposes, provided the direct source of light^is <br />not visible from the public right-of-way or adjacent residential <br />property. Such lights may be located to within 5 feet of the front <br />lot line. <br />C. Pences which do not exceed 3-1/2 feet in height; terraces, steps, <br />uncovered porches, stoops or similar structures, which do not extend <br />above the height of the ground floor level to the principal building <br />and extend to a distance of not less than 10 feet: from any lot line. <br />D. .In side or rear yards only bays which do not exceed a depth of 2 <br />feet nor which contain an area of more than 20 s.f.; fire escapes <br />which do not exceed a width of 3 feet; fences and walls which do not <br />exceed a height of 6 feet above original grade, except as regulated <br />hereinafter. <br />E. In rear yard only: accessory structures and equipment such ae <br />balconies, breezeways, detached outdoor picnic shelters and <br />recreational equipment except as regulated hereinafter, when such <br />accessory structures or equipment are located at least 5 feet from a <br />rear lot line. No fence or wall constructed within a rear yard shall <br />exceed a height of 6 feet above original grade. However, for lake- <br />shore lots which by definition do not have a front yard, but have only <br />a "lakeshore yard" and a "rear yard", no fence exceeding 3 —1/2 feec in <br />height is allowed within the required rear yard, except a fence not <br />exceeding 6 feet in height is allowed along the street lot line of <br />lake frontage lots which front on, but are not divided by, a major <br />thoroughfare (if fill is required, the total combined height of both <br />fence and fill shall not exceed 6 feet above the height of the crown <br />of the road). A major thoroughfare for purposes of this section is <br />any Federal, State, or County highway, or any MSA funded City road.
