<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7309 <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING A VARIANCE FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-1700 <br /> <br />FILE NO. LA22 -000001 <br /> <br /> WHEREAS, on December 27, 2021, John and Michelle Abbott (the “Abbotts”) along <br />with Tim and Leslie Oare (the “Oares”) (hereinafter the “Applicants”) applied for an administrative <br />boundary line adjustment or Subdivision Exception, under land use application #LA21-000078, to <br />split the land of the property addressed 2965 Casco Point Road and described as: Tract A, <br />Registered Land Survey No. 1470, Hennepin County, Minnesota, between their respective <br />properties resulting in two lots where three lots exist; and <br /> <br /> WHEREAS, Subdivision Exception approval is contingent upon prior approval of <br />hardcover variances for each property addressing the nonconforming hardcover levels; and <br /> <br /> WHEREAS, on January 2, 2022, the Applicants applied for hardcover variances from <br />the City Code under application #LA22-000001 for their properties: 2641 Casco Point Road as <br />described on attached Exhibit A and depicted on Exhibit B (hereinafter the “Abbott Property”); and <br />2967 Casco Point Road (hereinafter the “Oare Property”) as described on attached Exhibit A and <br />depicted on Exhibit B; and <br /> <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1700 for the Abbott Property to permit <br />27.5% hardcover where 25% is permitted; and <br /> <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1700 for the Oare Property to permit <br />27.4% hardcover where 25% is permitted; and <br /> WHEREAS, the Oares also requested a variance from the minimum lot area <br />requirement in Orono Municipal Zoning Code Section 78-348(2) to permit the existing home on <br />2965 Casco Point Road as a guest house on the yet-to-be-combined Oare property; <br /> WHEREAS, on February 22, 2022, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the <br />opportunity to speak thereon; and
