<br />3 <br /> <br />14. Dues, Subscriptions, and Continuing Education: Pursuant to the terms of the City <br />Personnel Policy the City shall budget and pay the dues and subscriptions for the Fire Chief <br />which are necessary for Chief's continued participation in national, regional, state and local <br />associations necessary and desirable for Chief's continued professional participation, growth <br />and advancement. <br /> <br />15. Professional Development: The City shall budget and pay the travel and subsistence <br />expenses of the Fire Chief for professional and official travel, meetings and occasions <br />adequate to continue the professional development of the Chief and to adequately pursue <br />necessary official and other committees thereof which Chief serves as a member. The Fire <br />Chief shall use good judgment in his / her outside activities so he/she will not neglect his <br />primary duties to the City. <br /> <br />16. Civic Club Membership. The City recognizes the desirability of representation <br />in and before local civic and other organizations. The Fire Chief is authorized to <br />become a member of such civic clubs or organizations as deemed appropriate by him <br />and at the City's expense. <br /> <br />17. Outside Activities: The employment provided for by this Agreement shall be the Fire <br />Chief’s sole employment. Recognizing that certain outside consulting or teaching opportunities <br />provide indirect benefits to the City and the community, the Fire Chief may elect to accept <br />limited teaching, consulting or other business opportunities with the understanding that such <br />arrangements shall not constitute interference with or be a conflict of interest with his <br />responsibilities under this Agreement. Any such activities shall be pre-approved by the <br />Administrator. <br /> <br />18. Indemnification: The City shall defend, hold harmless, and indemnify the Fire Chief <br />pursuant to state and local law, including but not limited to Minn. Stat. 466.07, as may be <br />amended from time to time. In event the City’s obligations pursuant to this paragraph are <br />triggered, the City shall retain the authority, but not the obligation, settle any such claim or suit <br />and pay the amount of any settlement or judgement thereon. <br /> <br />19. General Conditions of Employment. Nothing in this Agreement shall prevent, limit <br />or otherwise interfere with the right of the City to terminate the services of the Fire <br />Chief at any time, for any reason , subject only to the provision s of this Agreement and <br />statutory requirements . Furthermore, nothing in this Agreement shall prevent, limit or <br />otherwise interfere with the right of the Fire Chief to resign at any time from his/her <br />position with the City, subject only to the provisions of this Agreement. <br /> <br />20. Binding Effect: This Agreement shall be binding on the City and the Fire Chief. <br /> <br />21. Term: This Agreement shall remain in effect during the term of James Van Eyll’s <br />employment with the City as Fire Chief. This Agreement may be amended only by written <br />instrument, executed by James Van Eyll and the City. <br /> <br />This Agreement is now being executed by the parties as of the date stated at the beginning of this <br />Agreement.
