Purpose. <br />The City of Orono is proposing a zoning code text amendment that will add Accessory Dwelling Unit <br />(ADU) as a permitted accessory use in all residential zoning districts. <br /> <br />2. Background. In April 2022, Orono’s code review committee identified a need to create alternative <br />housing types to support multi-generational housing options within the City of Orono. The code review <br />committee and planning staff recently drafted a code amendment which would allow ADUs within the <br />residential districts in the City. The proposed language would permit and regulate permanent ADUs, <br />attached or detached. The text amendment removes Guest Houses and Nonrental Guest Apartments <br />which are currently listed as permitted and conditional uses in Residential districts, are no longer needed <br />as they would fall under the definition of an ADU. Additionally, the proposed language outlines <br />performance standards for ADUs. The performance standards are intended to protect the residential <br />character and quality of the existing neighborhoods. <br /> <br />Proposed Definition: <br />Accessory Dwelling Unit (ADU) means a subordinate habitable dwelling unit, which has its own basic <br />requirements of shelter, heating, cooking and sanitation, which is attached or detached from a single <br />family dwelling. <br /> <br />Proposed Performance Standards: <br />- Only 1 ADU is permitted per property <br />- The property must be one (1) acre in area or greater, <br />- Only allowed in residential districts <br />- ADUs can be attached or detached from the primary residence. <br />- Limited to a maximum of 50% total floor area of the primary dwelling size <br />- Must use the same utility connections as the primary residence. <br />- Designed to maintain consistency with the architectural style of the primary residence <br />- 2 off street parking spaces are required <br />- Must have a permanent foundation <br />- The property shall only have 1 address <br />- An ADU may not subdivided or segregated in ownership from the primary residence. <br />Permitting Requirements <br />- A building permit is required to construction an ADU <br />- ADUs are not eligible to obtain a rental license.
