<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> NO. 7302 <br /> <br /> <br /> <br />A RESOLUTION OF THE CITY COUNCIL <br />A RESOLUTION ACCEPTING THE SANITARY SEWER UTILITY WITHIN <br />ORCHARD CREEK AS A PUBLIC FACILITIES <br /> <br />WHEREAS, on July 12th , 2021 the City of Orono and ONYX Performance <br />Investments, LLC entered into Development Contract for Project LA21-37, (the "Contract") <br />which documented the terms and conditions under which the development known as Orchard <br />Creek was approved; and <br /> <br />WHEREAS, the terms and conditions of the Agreement state that final acceptance of the <br />improvements to be publicly owned, including water and sanitary sewer, shall take the form of a <br />Resolution passed by the Orono City Council, on the advice of the City Engineer; and <br /> <br />WHEREAS, the City Engineer has recommended that the City formally accept the water <br />and sanitary sewer; and <br /> <br />NOW, THEREFORE BE IT RESOLVED that the City Council of Orono does hereby <br />formally accept the Public Improvements (sanitary sewer) associated with Orchard Creek and <br />shall assume ownership and maintenance of said facilities. <br /> <br />Adopted by the City Council of Orono, Minnesota this 24th day of October, 2022. <br /> <br /> <br />ATTEST: <br /> <br /> <br /> <br /> <br /> <br />________________________ _______________________ <br />Anna Carlson, City Clerk Dennis Walsh, Mayor <br /> <br />
