Clearly, this change, if it were to occur today, would have <br />been considered an expansion of a non-conforming use. <br />Charles Maciosek, the current owner, was advised by the City to apply for <br />a conditional use permit to continue the legal non-conforming use during the <br />1983 review for a joint use dock license for Sandy Beach Shores. The <br />applicant, Mr. Zuckman, is in the process of negotiating the sale of the <br />property contingent on obtaining the necessary conditional use permit. <br />Zuckman plans to continue the gradual upgrading of the property as did <br />Maciosek. He will rent all seven units. The City has received no complaints <br />concerning the operation and use of the rental units. <br />The applicant should be advised that the property is a non-conforming use and <br />subject to all pertinent ordinances. He may also be advised, that at some <br />future date, the City would look very favorably on a PRD application or <br />possible duplex credit.
