The transitition was completed sometime in 1971 and the exhibits selected for your review would suggest that the City was fully aware of that transition. Clearly, this change, if it were to occur today, would have been considered an expansion of a non-conforming use. Charles Maciosek, the current owner, was advised by the City to apply for a conditional use permit to continue the legal non-conforming use during the 1983 review for a joint use dock license for Sandy Beach Shores. The applicant, Mr. Zuckman, is in the process of negotiating the sale of the property contingent on obtaining the necessary conditional use permit. Zuckman plans to continue the gradual upgrading of the property as did Maciosek. He will rent all seven units. The City has received no complaints concerning the operation and use of the rental units. The applicant should be advised that the property is a non-conforming use and subject to all pertinent ordinances. He may also be advised, that at some future date, the City would look very favorably on a PRD application or possible duplex credit.
