Vote: Ayes (1), Nays"^ (0) . <br />Member Grabek vacated his seat on the Committee <br />so that he could represent the application of the <br />Forest Arms Homeowners Association as their <br />current Chairman. Frahm stated that it would <br />appear the agreement between the Association and <br />the City pretty well determined the course of <br />action for the Committee. Grabek stated the <br />shared docks have been is use for several years <br />and that all interior lots were sold as riparian <br />to Lake Minnetonka via the shared dock area. <br />Frahm advised that although the agreement <br />approved a total of 14 slips (subject to <br />resolution of common ownership issue for one <br />property owner) that he would recommend that <br />current approved level be given for 12 slips <br />based on the number of developed lots. The <br />agreement would assure the applicant of a future <br />level of 14 slips. Frahm asked that in lieu of a <br />survey that applicant submit letters from <br />abutting property owners affirming their <br />approval of the proposed dock layout for 1983. <br />i-sPi - .'V!' <br />Frahm moved to recommend approval of a 1983 joint <br />use dock license for the Forest Arms Homeowners <br />Association subject to the following con­ <br />ditions: <br />rr-; <br />1. Hork <br />reviewed the current status of the proposed <br />agreement between North Sh.re Drive Marina and <br />the LMCD. He advised that all discussion had <br />come to a halt. Hork stated that he had no <br />problem with the City of Orono and that Bruce <br />Malkerson had recommended approval of 'Borth <br />Shore’s plan to pull back their docks within the <br />legal dock use area by 1983 season. <br />i ': fi- ■msm
