PAGE 14 <br />11929 RAHN <br />(Cont.) <br />Lyle Rahn stated yes he has used the structure as a guest house <br />for 10 years. <br />Rovegno moved, Sime seconded, to table the Lyle Rahn <br />application until staff can research the history of this <br />matter and get legal counsel regarding this matter. Motion, <br />Ayes (7), Nays (0). <br />#930 JIM SHAVER <br />1080 FERMDALE ROAD WEST <br />VARIANCES <br />PUBLIC HEARING 10:20 - 10:27 PH <br />Chairman Callahan called for the public hearing at 10:20 p.m.< <br />concerning Shaver * s variance application. Zoning Adminis <br />trator Mabusth noted the certificate of mailing and the <br />affidavit of publication. Jim Shaver was present. Jim <br />Thomson was present representing Alan McDowell at 905 <br />Ferndale Road West and R.C. Bagley of 1105 Ferndale Road <br />West. There was no one else present from the audience for <br />this public hearing. <br />f. <br />Tr. <br />Zoning Administrator Mabusth explained that the applicant <br />seeks a rear setback variance to construct a new home. <br />Mabusth noted that sewer is available to the property. <br />Mabusth noted that this is a very limited building envelope. <br />Jim ;^>haver noted that he discussed his proposal with the most <br />affected property owner (Lowry) and the owner had nothing <br />negative to say about proposal and does not object to <br />proposal. <br />Assistant Zoning Administrator Gaffron confirmed that Mr. <br />Lowry visited the office and affirmed his approval of the <br />application. <br />Jim Thomson was present to note the McDowell's and Bagley's <br />objection to this variance proposal. Thomson noted that the <br />applicant purchase the property in July, 1981 and a letter <br />was written to the applicant in May, 1981, confirming that a <br />home could be built without a variance. Thomson noted that <br />the applicant has not demonstrated any type of hardship for <br />the granting of the variance. Thomson noted that this house <br />obviously is more marketable but this is not a valid <br />hardship. Thomson noted that the applicant was made aware <br />of the limitations of the lot when he purchased the lot. <br />Jim Shaver stated that this is a very modest house plan (in <br />consideration of surrounding neighborhood). Shaver noted <br />the total square feet of the proposed home is 3,600. <br />Chairman Callahan stated that the letter the applicant <br />received was in error. Callahan noted for the record that <br />the property owner objecting to the proposal lives across the <br />road and this is a rear setback variance. Callahan noted <br />that the owner objecting is not the most affected property <br />owner. Callahan closed the public hearing at 10:27 p.m. <br />• ja <br />J
