MINUTES OF THE OROHO PLANNING COMMISSION MEETING HELD JUNE 17, 1985. PAGE 13 <br />M929 RAHN <br />(Cont‘.) <br />remove the existing guest house. Gaffron noted that the <br />applicant never complied with the condition of the variance <br />of approval. Gaffron stated that the original building <br />inspector retired and followup probably never happened. <br />Gaffron stated that the applicant made repairs to the illegal <br />structure after receiving a building permit for the repairs. <br />Lyle Rahn submitted three letters to the Planning Commission <br />(1 from previous riu'iii'iin'g Commieel-on member Welsh; 1 from <br />Thomas Shillock of Shillock Construction Company; and 1 from <br />Lyle Rahn—all letters are attached to these minutes). <br />Lyle Rahn addressed staff's memo and comments. Rahn noted <br />that he purchased the property in 1972 but because the <br />property was in estate they never closed on the property <br />until 1974. Rahn confirmed that the Council did grant a <br />variance but apparently the records do not show the <br />conditions that were also approved in terms of having the <br />cabin removed. Rahn confirmed that he did receive variance <br />approval and the variance expired before the building permit <br />was issued. Rahn stated that he reapplied and was granted <br />another variance. Rahn stated that he did obtain a building <br />permit for the home and a final inspection was made by Mike <br />Scheller as testified in the letter of Shillock Construction <br />Company. Rahn stated that a bank would not approve a loan <br />for a new home without a final inspection. <br />Lyle Rahn stated that he did do remodeling on the guest house <br />structure but that he didn' t know he needed a permit to change <br />carpet and change bathroom appliances on the structure. <br />Rahn stated that he has since learned from staff that he <br />cannot do a single thing ou his home (except paint) without a <br />permit. Rahn stated regarding staff's comment that the <br />guest house required a conditional use permit, that Tom <br />Jacobs caught him in a soft moment and went along with <br />applying for the conditional use permit. Rahn stated that <br />staff' s comment classifying the guest house structure exists <br />as an illegal structure is false and incorrect as testified <br />in Welsh's letter. Rahn stated that those of you who know <br />Welsh know that Welsh would not let an illegal structure <br />remain on his neighbors property. Rahn noted that he was <br />instructed to remove the top part of the structure and noted <br />that he conformed to that condition to reduce the structure <br />to ground level. <br />Lyle Rahn stated that he formally withdraws his application <br />as setforth in his letter to the City submitted tonight. <br />Rahn stated that apparently the minutes back then are just <br />the published minutes and not the "working" minutes. <br />Chairman Callahan closed the public hearing at 10:17 p.m. <br />Callahan asked if the applicant has used the structure as a <br />guest house.
