Zoning File #980 <br />October 11, 1985 <br />Page 2 of 2 <br />Per the Highway Department's report, Exhibit F, the County asks <br />for an additional right-of-way dedication of 7 feet providing a total <br />right-of-way width of 80 feet for County Road 15. This request is <br />denied by City maintaining the 66 feet of width for road classified as <br />scenic parking. <br />The request to close off eastern access will be upheld by the <br />City based on close proximity to intersection of County Road 15 and <br />Kelly. <br />The controversal underground gas tank has been removed by <br />Keaveny. <br />All sewer and water assessments have been paid on the property. <br />If additional units are required based on the proposed use of Lot 2, <br />the future owner will be responsible for all fee payments. <br />Park fee of $250.00 must be paid to the City for Lot 2. <br />Review Exhibit D, the City will ask that utility easements be <br />designated on the plat over existing sewer line and dedicated to the <br />public. <br />Staff Recommendation <br />To approve the two lot commercial plat application of Richard <br />Keaveny and a side setback variance for the existing building on Lot 1 <br />based on one or more of the following findings: <br />1. All other lot standards for the 3-1 district have been <br />satisfied. <br />2. The 100 feet width standard is minimal, any new independent <br />use to be established on Lot 2 would require more width based on <br />restrictive standards for corner lots. <br />3. There is adequate width available to satisfy such lot <br />standards but existing use patterns and proposed use patterns re­ <br />quire that lot li iO be located as proposed. <br />Approval is subject to the following conditions: <br />1. Most eastern access at County Road 15 must be closed off <br />prior to final plat approval. <br />2. Future owner of Lot 2 must connect to municipal water. <br />3. Owner/applicant must either relocate loading berth or future <br />owner of Lot 2 grant easement to Lot 1 for use of loading dock <br />area. <br />4. Payment of park fee of $250.00 for newly created Lot 2.
