Mabusth, Zoning Administrator <br />Date;August 13, 1985 <br />Subject: #950 George Rovegno, 2010 Shoreline Drive - <br />Appeal - Interpretation of Fence Ordinance - Public Hearing <br />Pertinent Ordinance: <br />Section 10.03, Subdivision 15 NON-ENCROACHMENTS - Amended 1/28/85 <br />C. Fences which do not exceed 3-1/2 feet n height, fences not over six <br />feet in height along the street lot line of lake frontage lots which front <br />on a major thoroughfare, if fill is required, the total combined height of <br />both fence and fill shall not exceed 6 feet above the height of the crown <br />of the road, terraces, steps, uncovered porches, stoops or similar <br />structures, which do not extend above the height of the ground floor level <br />of the principal building and extend to a distance of not less than two <br />feet from any lot line. <br />Other Sections of the Municpal Code appropriate for this review; <br />SECTION 10.22 Regulations for One Family Lakeshore Residential Districts. <br />Subdivision 1. Lakeshore Set Back Regulations. The set back from the <br />shoreline for lakeshore lots shall be at least 75 feet and no building, <br />fence or wall over forty-two inches but not in exce.'^ of seventy-two inches <br />in height above original grade may be located closer to the shoreline than <br />the average distance from the shoreline of existing residence buildings on <br />adjacent lots. <br />SECTION 9.21. PUBLIC NUISANCE. It is unlawful for any person to maintain <br />a public nuisance by his act or failure to perform a legal duty, and for <br />purposes of this Section, a public nuisance shall be defined as any of the <br />following: (1) maintaining or permitting a condition which unreasonably <br />annoys, injures or endangers the safety, health, morals, comfort or repose <br />of any considerable number of members of the public; or, (2) interfering <br />with, obstructing or rendering dangerous for passage, any street, public <br />right-of-way, or waters used by the public; or, (3) any other act or <br />omission declared by law to be a public nuisance. <br />SECTION 9.22. PERMITTING A PUBLIC NUISANCE.
